Terms of Service

These Terms of Service ("Terms") govern your access to and use of SCALE LOCAL Mail and the email-related services provided by SCALE LOCAL ("SCALE LOCAL", "we", "us", or "our").
By requesting an account, receiving access credentials, or using SCALE LOCAL Mail, you agree to these Terms and our Privacy Policy.
1. The Service
SCALE LOCAL Mail provides privately managed email accounts, webmail access, mailbox organization, account preferences, storage, attachment handling, domain-based mailbox configuration, and related email-management functionality.
Available features may depend on your account configuration, service plan, domain configuration, infrastructure, and the features currently enabled for your account.
2. Account Requests
SCALE LOCAL Mail does not provide unrestricted automatic registration.
Prospective users may submit a Get Started request through the public website. Submitting a request does not automatically create an account, reserve an email address, establish a service agreement, or guarantee approval.
We may approve, decline, or request additional information regarding an account request at our discretion and subject to applicable law.
3. Domain Ownership and Authorization
You may request an email address using only a domain that you own, control, or are otherwise authorized to use.
We may request reasonable evidence of domain ownership, administrative control, or authorization before provisioning an account or enabling domain-related functionality.
You must not request, register, or use an email address in a manner that impersonates another person, organization, or brand without authorization.
4. Account Provisioning
Mailbox accounts are provisioned only after approval by the service administrator.
We may establish account-specific limits including mailbox quotas, storage limits, folder availability, security requirements, attachment restrictions, and other operational controls.
5. Account Security
You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account.
You must use reasonable security practices and must not knowingly share credentials with unauthorized persons.
You should promptly notify us if you believe your password, mailbox, device, or account has been compromised.
We may require a password reset or temporarily restrict account access where reasonably necessary to protect the service or its users.
6. Acceptable Use
You agree to use SCALE LOCAL Mail only for lawful and authorized purposes.
You must not use the service to:
- Gain or attempt to gain unauthorized access to another mailbox, account, system, server, database, or network.
- Impersonate another person or organization without authorization.
- Distribute malware, malicious code, credential-stealing content, or other intentionally harmful material.
- Engage in fraud, phishing, identity theft, harassment, unlawful surveillance, or other unlawful activity.
- Circumvent authentication, security, storage, quota, or access-control mechanisms.
- Interfere with or deliberately degrade the availability, performance, or security of the service.
- Use the service in violation of applicable laws, regulations, contractual obligations, or the rights of others.
7. Your Email and Content
You retain any rights you lawfully hold in email messages, attachments, files, profile information, and other content associated with your account.
You grant us permission to process such information only as reasonably necessary to provide, secure, maintain, troubleshoot, back up, and administer the service, subject to our Privacy Policy and applicable law.
You are responsible for ensuring that content you place within the service may lawfully be stored, accessed, and processed.
8. Privacy
Our collection and processing of personal information is governed by the SCALE LOCAL Mail Privacy Policy.
You are also responsible for complying with applicable privacy obligations when using an email account to process information relating to other individuals.
9. Mailbox Storage and Quotas
Accounts may be assigned storage quotas or other technical limits.
When an account approaches or exceeds its applicable limits, certain functions may be restricted until storage is reduced, additional capacity is approved, or other arrangements are made.
Quotas and limits may change where reasonably necessary for security, capacity management, service operation, or an applicable service arrangement.
10. Attachments and Message Content
Email messages and attachments may contain potentially unsafe content. SCALE LOCAL Mail may apply technical controls intended to reduce security risks, including restrictions on message rendering, external resources, attachments, and other content.
These controls do not guarantee that all malicious or harmful content will be detected.
11. Service Availability
We aim to operate SCALE LOCAL Mail reliably, but continuous, uninterrupted, or error-free availability is not guaranteed.
Service may be temporarily interrupted because of maintenance, security updates, infrastructure changes, network problems, software updates, backups, outages, or circumstances outside our reasonable control.
Any specific availability commitment must be stated in a separate written service agreement.
12. Maintenance and Changes
We may update, modify, replace, restrict, or discontinue features where reasonably necessary for security, reliability, technical improvement, legal compliance, or service development.
Where reasonably practicable, significant changes affecting normal account use may be communicated to affected users.
13. Suspension
We may temporarily suspend or restrict an account where reasonably necessary because of:
- Suspected unauthorized access or account compromise.
- A material violation of these Terms.
- Activity presenting a security or operational risk.
- Applicable legal or regulatory requirements.
- Misrepresentation regarding domain ownership or authorization.
- Failure to satisfy an applicable service or payment obligation.
14. Account Termination
Accounts may be terminated in accordance with an applicable service agreement, at the user's request, following material violations of these Terms, or where continued operation would create unreasonable legal, security, or operational risk.
Data handling following termination will be subject to applicable law, our Privacy Policy, operational retention requirements, backup practices, and any separate agreement with the account holder.
15. Backups
We may maintain backups as part of normal service operation. Unless expressly agreed otherwise in writing, SCALE LOCAL Mail should not be treated as the only independent backup copy of information that you are legally or operationally required to retain.
16. Third-Party Infrastructure
SCALE LOCAL Mail may rely on third-party infrastructure and services such as hosting providers, network providers, domain registrars, certificate authorities, software components, and other technical services.
Availability or performance may therefore occasionally be affected by systems outside our direct control.
17. Intellectual Property
SCALE LOCAL Mail software, branding, visual design, documentation, service interfaces, and related materials are owned by or licensed to SCALE LOCAL and are protected by applicable intellectual property laws.
These Terms do not transfer ownership of our software, trademarks, branding, or other intellectual property to you.
18. Fees and Paid Services
If paid services, subscriptions, custom hosting, additional storage, or other paid features are offered, applicable pricing and payment terms will be communicated separately.
No payment obligation is created merely by submitting a Get Started request.
19. Disclaimer
Except where expressly provided in a separate written agreement and to the maximum extent permitted by applicable law, the service is provided on an "as available" basis.
We do not guarantee that the service will always be uninterrupted, free of defects, compatible with every device or application, or immune from every security threat.
20. Limitation of Liability
To the maximum extent permitted by applicable law, SCALE LOCAL and its personnel will not be liable for indirect, incidental, consequential, exemplary, special, or punitive damages arising solely from access to or use of the service.
Nothing in these Terms excludes or limits any liability or legal right that cannot lawfully be excluded or limited.
21. Compliance With Law
You must use the service in compliance with all laws and regulations applicable to you, your organization, your domain, your communications, and the information processed through your account.
22. Changes to These Terms
We may update these Terms to reflect changes in the service, applicable requirements, security practices, or business operations.
The effective date at the top of this page identifies the currently published version.
23. Entire Agreement
These Terms, together with the Privacy Policy and any separate written service agreement applicable to your account, constitute the terms governing your use of SCALE LOCAL Mail.
If a separate signed service agreement conflicts with these Terms, the separate agreement will control to the extent of that conflict.
